Emiri Decree No. (19) of 2023 On Allocating Plots Within Sustainable Residential Communities for Ras Al Khaimah Emirate Citizens We, Saud Bin Saqr Bin Mohamed Al Qasimi Ras Al Khaimah Ruler After perusal of the United Arab Emirates Constitution; And United Arab Emirates Civil Transactions Law No. (5) of 1985, as amended; And Ras Al Khaimah Municipality Law of 1981, as amended; And Lands Grant Law of 1981, as amended; And Public Services Department Law No. 3 of 2017; And Law No. (7) of 2012 on Establishing Executive Council of Ras Al Khaimah Emirate; And Law No. (11) of 2021 on Land Register in Ras Al Khaimah Emirate; promulgated the following Decree: Article (1) In implementation of this Decree provisions, the following words and phrases shall have the meanings indicated opposite each of them respectively, unless context otherwise requires: Emirate: Ras Al Khaimah Emirate Municipality: Municipality Department in the Emirate Department: Public Services Department in the Emirate Sustainable Residential Communities: Residential communities in the Emirate with integrated services and facilities within specific areas developed in accordance with sustainable development standards determined by the Municipality Beneficiary: Any of the Emirate citizens for whom a plot is allocated under the provisions of this Decree and are eligible for a land grant under the provisions of Land Grant Law of 1981, as amended Law: Land Grant Law of 1981, as amended Article (2) Those who meet the conditions set forth in the Law shall be allocated a residential plot to build family home within the sustainable residential communities in the Emirate. Article (3) It is not permissible to allocate more than one plot to the beneficiary within such communities or others in the Emirate. Article (4) The locations, plans, designs and fees of sustainable residential communities shall be determined based on a proposal from the Municipality and the Department. Article (5) The Department shall manage and develop sustainable residential communities’ services and collect the prescribed fees and fines in this regard. Article (6) Both Municipality and Department shall issue the regulations, decisions, instructions, fees and fines schedules necessary for applying this Decree, each within competence thereof. Article (7) The provisions of the Law shall apply to what is not specifically stipulated in this Decree. Article (8) This Decree shall come into force as date of its promulgation and be published in the Official Gazette. Saud Bin Saqr Bin Mohamed Al Qasimi Ras Al Khaimah Ruler Promogulated by us on this day eleventh of Rabie II 1445H. Corresponding to twenty sixth of October 2023G.

    Municipality: Municipality Department in the Emirate
    Department: Public Services Department in the Emirate
