Law No. (6) of 2022 On Eco-Label for Establishments in Emirate of Ras Al Khaimah We, Saud Bin Saqr Bin Mohamed Al Qasimi Ruler of Ras Al Khaimah After perusal of the Constitution; And Federal Law No. 24 of 1999 on Protecting & Developing Environment; And Law No. 2 of 2007 on Establishing Environment Protection & Development Authority in Ras Al Khaimah, as amended; And after approval of the Executive Council; Promulgated the following Law: Article (1) In implementing the provisions of this law, the following words and phrases shall have the meanings corresponding to each of them respectively, unless context otherwise stipulates: Emirate: Emirate of Ras Al Khaimah. Authority: Environment Protection & Development Authority in Ras Al Khaimah. Label: Eco-label of the Emirate. Article (2) Without prejudice to Cabinet’s resolution no. (12) of 2017, on UAE System of Eco-Label for Systems & Products, the Authority shall launch eco-label for the emirate to be licensed for use in establishments that meet the standards of such label. The Authority shall determine the label pattern, its licensing standards and procedures and terms of using it. Article (3) The Authority shall impose a charge of ten thousand dirham for licensing the establishments to use the label, half thereof shall be paid upon applying to get it and the other half when the establishment passes the initial inspection phase. The Authority shall use the paid charges to cover the wages of consultants and expenses related to the label. Article (4) Charges stated in article (3) of this law may be amended under resolution issued by the Executive Council upon Authority’s proposal. Article (5) Without prejudice to any severer penalty stipulated in any other law, whoever alleged that he got the eco-label of the emirate by any means or placed such label on products without granting it to him by the Authority or on products that do not meet the standards based thereon the label had been granted, shall be punished by a fine not less than one thousand dirhams nor more than twenty thousand dirhams and the penalty shall be doubled if the same violation had been repeated within a year from committing the previous violation. Article (6) The proceeds of fines resulting from violating the provisions of this law shall devolve upon the Authority which is entitled to reconcile with the violator in case he pays the minimum limit of the stipulated fine, after removing the reasons of the violation and in case the violator does not accept reconciliation, the matter shall be referred to Public Prosecution and in the event of conviction, the fine should not be less than five thousand dirhams. Article (7) Employees of the Authority, designated by resolution from Authority’s Chairman, shall be empowered with capacity of law officer in proving acts committed in violation of provisions of this law and resolutions issued in implementation thereof. Article (8) Authority’s Chairman or whomever he authorizes, shall issue the necessary resolutions to implement provisions of this law. Article (9) This law shall come into force as date of its issuance and be published in the Official Gazette.
