Law No. 3 of 2020 Regarding Licensing, Renting & Using Jet Skis We, Saud Bin Saqr Bin Mohamed Al Qasimi - Ruler of Ras Al Khaimah After perusal of the Constitution of United Arab Emirates; And Federal Law No. 5 of 1975 on Commercial Register; And Federal Law No. 12 of 1976 on Police & Security Force, as amended; And Federal Law No. 3 of 1987 on issuing Penal Code, as amended; And Federal Law No. 35 of 1992 on issuing Criminal Procedures Code, as amended; And Federal Law No. 18 of 1993 on issuing Commercial Transactions Code, as amended; And Federal Law No. 19 of 1993 on Delimitation of Marine Areas of United Arab Emirates; And Federal Law No. 23 of 1999 on Exploiting, Protecting & Developing Living Aquatic Resources in United Arab Emirates, as amended; And Federal Law No. 24 of 1999 on Protecting & Developing Environment, as amended; And Federal Law No. 1 of 2001 on Guarding Land & Sea Borders of the State; And Federal Law No. 2 of 2015 on Commercial Companies, as amended; And RAK Municipality Law of 1981; And Law No. 2 of 2007 on Establishing RAK Environment Protection & Development Authority; And Law No. 7 of 2012 on Establishing RAK Executive Council; And Law No. 8 of 2016 on Regulating Practicing Economic Activities in Emirate of Ras Al Khaimah; And Law No. 2 of 2017 on Establishing RAK Economic Zone & Supervising Authority; And Law No. 4 of 2019 on Seizing & Placing Vehicles; And based on the approval of the Executive Council; Have promulgated the following Act: Article (1) In implementing the provisions of this law, the following words and phrases shall have the meanings corresponding to each of them respectively, unless context otherwise indicates: State: United Arab Emirates. Emirate: Emirate of Ras Al Khaimah. Executive Council: Executive Council of Emirate of Ras Al Khaimah. Competent Authority: RAK Police General Headquarters. Commander-in-chief: RAK Police Commander-in-chief Concerned Authorities: Ras Al Khaimah Municipality Department, Ras Al Khaimah Environment Protection & Development Authority, Ras Al Khaimah Tourism Development Authority & Ras Al Khaimah Water Ski Club Jet Ski: It is every marine means with a motor, prepared to float on the water surface, designated for the use of individuals in marine sports and the like, and by their nature devoid of ships and boats and all marine machinery and equipment regulated by their own laws. Marine Areas: Areas where it is permitted to unleash jet skis into water or use them therein Facility: each natural or legal person, licensed by licensing authority to practice renting jet skis to others and train on using the same according to the provisions of this law. User: Each natural person uses jet ski whether he is owner thereof or authorized to use it or rent it. Article (2) The provisions of this law shall apply to jet skis and facilities operating in renting jet skis and training on using the same in the emirate including RAK Economic Zones. Article (3) It is prohibited to unleash or use jet skis into the marine areas unless they are licensed by the competent authority or any other competent authority outside the emirate. Temporary permit may be granted for races purposes or any other temporary event considered by the competent authority. The executive regulation shall regulate the necessary conditions to grant license or permit and validity period thereof. Article (4) Marine areas and authorized times to use jet skis shall be determined by resolution from the Commander-in-Chief in coordination with concerned authorities, each within its competence. The Commander-in-Chief or his authorized representative may prevent using jet skis in unsuitable weather conditions announced by warning bulletin issued by the authority concerned with meteorology. Article (5) The executive regulation of this law shall determine the following: 1- Technical specifications that should be met in the jet skis. 2- The conditions that should be met by the user and controls of use. 3- Mechanism of control and inspection on jet skis and facilities. Article (6) The concerned authorities, each according its competence, shall coordinate with the competent authority in seizing violations related to provisions of the law. Article (7) Without prejudice to any more severe penalty stipulated by any other legislation in the emirate, each one violates the provisions of this law and the executive regulation thereof shall be subject to fines and measures stipulated in the schedule attached to the regulation. Article (8) Conciliation may be made in respect of the violations stipulated in the previous article against half of fine value. Article (9) The provisions of Law no. 4 of 2019 on seizing, placing and disposing vehicles shall apply to jet skis left in marine areas and a resolution to place them shall be issued by Commander-in-chief or his authorized representative. According to the provision of article 3 of the aforementioned law, jet ski shall be considered left by elapsing of three months from the date of notifying its owner of the seizure incident. Article (10) Owners of jet skis and facilities shall regularize their conditions in light of provisions of this law and the executive regulation thereof. Article (11) The Executive Council shall issue the executive regulation of this law and attach fees and fine table thereto.
